Contract: Terms of Service - Trilogy Fitness
1. Introduction
These Terms of Service ("Terms") govern your use of Trilogy Fitness's website and services. Throughout this document, "we," "us," and "our" refer to Trilogy Fitness, located at 1550 N Federal Hwy, Boynton Beach, FL 33435. (A) By accessing our website or purchasing our services, you agree to be bound by these Terms. Please read them carefully.
2. Membership Terms
2.1 Renewal and Termination
● Memberships automatically renew at current rates unless canceled with 30 days written notice
● A cancellation fee equivalent to three months' dues applies
● We reserve the right to modify fees and terms with prior notice
2.2 Access and Usage
● Members must present their unique membership ID upon entry
● Membership access is personal and non-transferable
● Replacement IDs are available for a fee
2.3 Payment Terms
● Membership fees of $149 are processed via Autopay on the 1st or 15th of each month
● Late payments incur a $25 fee
● We reserve the right to adjust fees annually with prior notification
2.4 Fixed-Term Memberships
● Fixed-term memberships cannot be canceled before their term ends Such memberships may renew for equal durations unless otherwise specified in writing
3. Cancellation Rights
3.1 General Cancellation Provisions
Members are entitled to the penalty-free cancellation of this contract within 3 days, exclusive of holidays and weekends, of its making, upon the mailing or delivery of written notice to the health studio, and refund upon such notice of all monies paid under the contract, except that the health studio may retain an amount computed by dividing the number of complete days in the contract term, or if appropriate, the number of occasions health studio services are to be rendered into the total contract price and multiplying the result by the number of complete days that have passed since the making of the contract or, if appropriate, by the number of occasions that health studio services have been rendered. A refund shall be issued within 30 days after receipt of the notice of cancellation.
Members are entitled to the cancellation and refund of the contract if the contracting business location of the health studio goes out of business, or moves its facilities more than five (5) driving miles and fails to provide, within 30 days, a facility of equal quality located within five (5) driving miles at no additional cost to the buyer.
That if the department determines that a refund is due the buyer, the refund shall be an amount computed by dividing the contract price by the number of weeks in the contract term and multiplying the result by the number of weeks remaining in the contract term. The business location of a health studio shall not be deemed out of business when temporarily closed for repair and renovation of the premises:
The contract may be cancelled if the buyer dies or becomes physically unable to avail himself or herself of a substantial portion of those services which he or she used from the commencement of the contract until the time of disability, with refund of funds paid or accepted in payment of the contract in an amount computed by dividing the contract price by the number of weeks in the contract term and multiplying the result by the number of weeks remaining in the contract term. The buyer or the buyer's estate seeking relief under this paragraph may be required to provide proof of disability or death. A physical disability sufficient to warrant cancellation of the contract by the buyer shall be established if the buyer furnishes to the health studio a certification of such disability by a physician licensed under Chapter 458, 459, 460 or Chapter 461 to the extent the diagnosis or treatment is within the physician’s scope of practice. A refund shall be issued within 30 days after receipt of the notice of cancellation.
● All cancellation notices must be given in writing to Trilogy Fitness
● Your written notice of cancellation automatically terminates any obligations to entities to whom we have subrogated or assigned your contract
● If we wish to enforce the contract after receiving your cancellation notice, we may request the Florida Department of Agriculture & Consumer Services to determine the sufficiency of the notice
3.2 Specific Cancellation Circumstances
Members may cancel their contract under the following circumstances:
1.Within 3 business days (excluding holidays and weekends) of signing, with written notice
2.If we relocate more than 5 driving miles away without providing a comparable facility
3.In the event of member death or physical disability (proof may be required)
4.If we cease operations (contact Florida Department of Agriculture & Consumer Services within 60 days)
3.3 Refunds and Calculations
If the Department determines that a refund is due, the refund amount will be calculated by: 1. Dividing the contract price by the number of weeks in the contract term and multiplying the result by the number of weeks remaining in the contract term . All refunds will be issued within 30 days of receiving the cancellation notice
3.4 Temporary Closures
Our location is not considered out of business when temporarily closed for repair and renovation under these circumstances:
1. Upon sale: closed for not more than 14 consecutive days
2. During ownership: closed for not more than seven (7) consecutive days and not more than two (2) periods of seven (7) consecutive days in any calendar year
4. Contract Terms
The initial contract will not exceed 36 months and thereafter shall only be renewable annually. Renewal contracts may not be executed and the fee therefore paid until 60 days or less before the preceding contract expires.
a. If this studio sells a single contract for 30 days or less, without any option or other condition which establishes any right or obligation of a member beyond the 30-day period then provision 1 should read as follows: “The initial contract will not be for a period in excess of 30 days. Renewal contracts may not be executed, and the fee therefore paid until the preceding contract expires.”
b. If this studio sells SESSIONS in this manner (7a) then the contract must ALSO indicate: “All sessions must be used within 30 days.”
4.1 Contract Duration and Renewal
For contracts longer than 30 days:
● Initial contracts will not exceed 36 months
● After the initial term, contracts shall only be renewable annually
● Renewal contracts may not be executed and fees may not be paid until 60 days or less before the preceding contract expires
4.2 General Contract Requirements
● All contracts include our health studio registration number
● Written contracts will specify all charges and fees
● Members will receive a copy of their signed contract
5. Privacy Policy
5.1 Data Collection and Usage
● We collect personal and billing information for operational purposes, Data may be used to enhance services, process payments, communicate updates
5.2 Data Protection
● We implement security measures to protect your data
● We are not liable for third-party breaches
● You may request access to or deletion of your data
6. Studio Policies
6.1 Class Guidelines
● Arrive on time for classes
● Cancel at least 24 hours in advance to avoid fees
● Wipe down equipment after use
● Wear appropriate athletic attire
6.2 Facility Usage
● Lockers are for day use only
● We are not responsible for lost items
● Guests must sign a waiver and follow studio rules
7. Liability Disclaimer
Participation in fitness activities carries inherent risks. Members are advised to consult a physician before beginning any exercise program. Trilogy Fitness is not liable for injuries, illnesses, or damages arising from participation in our services.
